Cancellation Policy
In the event of a Client cancellation occurring 90 days prior, liquidated damages in the amount of one hundred percent (100%) of the Room Night Commitment, one hundred percent (100%) of the Minimum Food and Beverage Revenue, and Total Function Fee will be due, plus applicable taxes. In the event of a group cancellation occurring 90 days to 120 days prior to arrival, liquidated damages in the amount of fifty percent (50%) of the Room Night Commitment and fifty percent (50%) of the Minimum Food and Beverage Revenue and Total Function Fee will be due, plus applicable taxes. In the event of a group cancellation occurring between the time of acceptance of this contract and 270 days prior to arrival, liquidated damages in the amount of zero percent (0%) of the Room Night Commitment and twenty-five percent (25%) of the Minimum Food and Beverage Revenue and Total Function Fee will be due, plus applicable taxes. Under the terms of this Agreement, the Hotel is reserving the room block requirements herein for your use. In the event these reserved facilities and related services are not used, the Hotel will experience significant monetary losses. In the event of cancellation by the client more than ninety (90) calendar days prior to the event date, The Hotel will refund 100% of the room's deposit less any additional processing fees. In the event of cancellation by the client less than ninety (90) days prior to the event date, the Hotel will retain 100% of the room's deposit. Such action is not a default but rather the exercise of a right under this Agreement to cancel the Agreement without any further obligation. Any purported exercise of this right without the inclusion of payment as set forth above shall not be valid. This payment shall be for liquidated damages and is not a penalty. Liquidated damages resulting from cancellation shall be due and payable at the time of cancellation.
