An update on residential tenancies and COVID-19

It has been a big week with further engagement by the State Government about proposed regulations to guide COVID-19 responses to the needs of tenants.
On Wednesday night the COVID-19 Emergency Response Bill passed Parliament. This includes enacting the framework for Queensland to implement the National Cabinet Committee decision on an eviction moratorium in relation to hardship caused by COVID-19. The legislation can be found here  
Greater detail will be available in the Regulation which will be available in the near future. You can click here to access the explanatory notes to the legislation.  
There is a Residential Tenancies Practice Guide available (draft) to assist both organisations, tenants and property owners with the new provisions, and is available online here.  
The detail relating to residential tenancies can be found in the Residential Tenancies and Rooming Accommodation (COVID-19 Emergency Response) Regulation 2020. This can be found here.  
The Residential Tenancies Authority (RTA) has a new online COVID-19 dispute resolution request available here. On this page there is a link to tool where tenants/owners/agents can check eligibility for COVID-19 rental reconciliation. It is also available as a form here
The RTA also have a new Dispute Resolution Form (16A) available for COVID-19 disputes. You can click here to download this form.  
The Queensland Rental Hub is a central source  of information from the Queensland Government on these measures and can be accessed here
Q Shelter is also working with REIQ and the RTA to adapt webinars and other tools to our sector. 
A role for housing providers and support services
I encourage all housing providers and support agencies to become familiar with the Practice Guide and Legislation. It is vital that housing providers and support providers are all familiar with the proposed changes so that there is holistic support for tenants to address their needs and also fulfil their obligations.
